These Terms & Conditions (“Terms”) govern your use of the Queen SNOWWORKS website, online store, products, product information, and related services. Queen SNOWWORKS LLC (“Queen SNOWWORKS,” “QSW,” “we,” “us,” or “our”) designs, manufactures, and sells snowboard hardgoods, splitboard products, surf/pow-surf traction pads, binding components, accessories, replacement parts, apparel, prototypes, and related products (“Products”).
By accessing our website, purchasing a Product, installing a Product, using a Product, participating in a demo, or submitting content to QSW, you agree to these Terms. If you do not agree, do not use our website or purchase, install, test, demo, or use any QSW Product.
These Terms include important language about product risk, assumption of risk, warranty limitations, release of claims, indemnification, and limitation of liability. Please read them carefully.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase Products from QSW. If you are under 18, you may use our website or Products only with the involvement and consent of a parent or legal guardian.
We reserve the right to refuse service, cancel orders, restrict access, or discontinue services at our discretion, including where we believe a customer has violated these Terms, abused our policies, created risk, or attempted fraud.
2. Product Risk and Assumption of Risk
Snowboarding, splitboarding, powsurfing, bindingless riding, backcountry travel, avalanche terrain travel, bootpacking, and related mountain activities are inherently dangerous. These activities may result in serious injury, paralysis, death, property damage, or other loss.
Risks include, but are not limited to:
falls, collisions, impacts, and loss of control;
avalanches, tree wells, terrain traps, cliffs, rocks, trees, ice, variable snow, and hidden obstacles;
weather exposure, hypothermia, frostbite, fatigue, poor visibility, and navigation errors;
equipment malfunction, improper setup, improper installation, misuse, wear, third-party incompatibility, rider error, and changing field conditions;
injury or death caused by other people, rescue delays, or lack of medical care.
By purchasing, installing, testing, demoing, or using any QSW Product, you knowingly and voluntarily assume all risks associated with the Product and the activity in which it is used, whether known or unknown, foreseeable or unforeseeable, inherent or equipment-related, to the fullest extent permitted by law.
QSW Products are performance snowboard hardgoods and accessories. They are not safety devices. No QSW Product can eliminate the risks of snowboarding, splitboarding, powsurfing, backcountry travel, avalanche exposure, falls, impacts, equipment failure, improper installation, or user error.
3. Backcountry, Avalanche, and Bindingless Riding Disclaimer
QSW Products are not avalanche safety equipment. They do not predict, prevent, detect, or protect against avalanches, burial, trauma, hypothermia, or backcountry emergencies. You are solely responsible for avalanche education, rescue equipment, terrain decisions, weather and snowpack evaluation, partner selection, and knowing when not to enter hazardous terrain.
QSW Surf Series Products and traction pads may allow riders to use standard snowboards or splitboards in a bindingless or pow-surf style. Bindingless riding involves added risk because your boots are not mechanically attached to the board. This can increase the chance of board separation, loss of control, runaway equipment, collision, injury, or injury to others.
You are solely responsible for deciding whether a Product, terrain, condition, and riding style are appropriate for your ability, setup, and risk tolerance.
4. Installation, Compatibility, Inspection, and Use
QSW Products require correct installation, compatible equipment, proper adjustment, regular inspection, and ongoing maintenance. Improper installation or use can cause poor performance, product failure, loss of control, serious injury, death, or property damage.
Before each use, inspect your Product and full setup, including fasteners, mounting interfaces, traction features, studs, cables, straps, pucks, risers, plates, hardware, boot interfaces, board interfaces, and related components.
Do not use any Product that appears damaged, excessively worn, loose, altered, improperly installed, incompatible, or unsafe.
You are responsible for:
reading and following all installation instructions, warnings, and product guides;
using correct tools, torque, fasteners, mounting patterns, and compatible equipment;
confirming compatibility with your board, boots, bindings, pucks, inserts, plates, risers, and hardware;
replacing worn, damaged, missing, or compromised parts before use;
seeking help from a qualified technician or professional shop when needed;
stopping use immediately if a Product shows cracking, loosening, abnormal wear, malfunction, stripped threads, hardware loss, bending, delamination, instability, or compromised performance.
Website content, product pages, videos, emails, manuals, and guides are for general information only. They are not professional safety advice, avalanche advice, guiding advice, medical advice, legal advice, engineering certification, or a substitute for qualified instruction or professional fitting.
5. Product Testing, Demos, and Prototypes
QSW may conduct or support demos, athlete testing, field testing, prototype testing, beta programs, events, or early-access use. These activities may require separate waivers, releases, or testing agreements.
Prototype, demo, sample, beta, pre-production, and field-test Products may differ from final production Products and may carry added risk or uncertainty. Unless QSW states otherwise in writing, these Products are provided for evaluation only and may not be resold, rented, commercially used, copied, reverse engineered, modified, or distributed.
By participating in any demo or testing program, you agree that you are voluntarily participating, you understand the risks, you are responsible for your own safety and decisions, and you will stop use immediately if anything appears unsafe.
6. Product Information and Accuracy
We make reasonable efforts to describe Products accurately, but we do not guarantee that descriptions, specifications, weights, colors, images, compatibility statements, performance descriptions, availability, prices, or testing statements are complete, current, error-free, or applicable to every user, setup, or condition.
Product appearance, color, finish, texture, hardware, geometry, packaging, and details may vary due to manufacturing changes, supplier changes, prototyping, production updates, display settings, photography, small-batch production, or continuous improvement.
Stated weights, dimensions, performance characteristics, testing results, and compatibility information are approximate unless expressly stated otherwise. Field performance depends on rider ability, installation, setup, terrain, conditions, maintenance, compatible equipment, and use.
If a Product is materially not as described, your sole remedy is to return it in unused condition under our return policy or submit a warranty claim if applicable.
7. Orders, Payments, Pre-Orders, and Availability
Placing an order does not guarantee acceptance. We may accept, reject, limit, cancel, or modify any order at our discretion, including due to suspected fraud, pricing errors, inventory issues, shipping restrictions, payment issues, product discontinuation, or risk concerns.
You agree to pay all prices, taxes, shipping charges, handling charges, and other fees shown at checkout. Payments may be processed by third-party payment providers. We are not responsible for third-party payment processor errors, outages, delays, or security incidents, except where required by law.
We may correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. If a Product is listed at an incorrect price or with incorrect information, we may cancel or refuse the order and issue a refund.
Some Products may be sold as pre-orders, limited releases, small-batch drops, early-access items, or made-to-order Products. Estimated shipping dates are estimates only and may change due to manufacturing, supplier delays, testing, quality control, weather, carrier delays, or other factors. If a delay requires notice or consent under applicable law, we will provide it.
QSW may change, improve, update, discontinue, or limit Products at any time. We do not guarantee that any Product, part, color, size, configuration, or replacement component will remain available indefinitely.
8. Shipping and Delivery
Shipping options, costs, and estimated timelines will be shown at checkout when available. Delivery estimates are not guarantees.
Risk of loss and title for Products pass to you when the Product is delivered to the carrier, unless applicable law requires otherwise. You are responsible for providing accurate shipping information. We are not responsible for delays, failed deliveries, lost packages, customs delays, duties, import taxes, incorrect addresses, theft after delivery, carrier errors, or weather-related shipping delays, except where required by law.
For international orders, you are responsible for complying with local laws, import rules, taxes, duties, fees, and customs requirements. Some Products may not be available or lawful in all jurisdictions.
9. Returns, Exchanges, and Refunds
Unless otherwise stated on the Product page or at checkout, unused Products may be returned within 30 days of delivery. Returned Products must be unused, uninstalled, undamaged, complete, and in original or appropriate packaging.
We may reject returns or reduce refunds for Products that are used, damaged, incomplete, altered, contaminated, missing parts, or not in resalable condition.
Shipping charges, return shipping, route protection, customs duties, taxes, and handling fees may be non-refundable unless required by law or unless the return is due to our error.
Final-sale, custom, modified, prototype, demo, clearance, used, field-test, or special-order Products may not be returnable unless QSW states otherwise in writing or unless required by law.
Refunds will be issued to the original payment method when possible. Processing times may vary depending on payment providers and banks.
10. Limited Warranty
QSW stands behind its Products, but warranties are limited and subject to exclusions. Warranty coverage may vary by Product and may also be described on a separate Warranty page or Product-specific documentation.
Unless otherwise stated in writing:
primary structural aluminum binding components, including binding frames, canting pads, and buffer plates, are covered by a limited lifetime warranty for the original owner;
other binding components are covered by a 3-year limited warranty for the original owner;
QSW Surf Series traction pad Products are covered by a 3-year limited warranty for the original owner.
The limited warranty covers defects in materials or workmanship under normal intended use, subject to inspection and approval by QSW.
The warranty does not cover:
normal wear and tear;
cosmetic damage, scratches, scuffs, dents, fading, discoloration, or finish wear;
damage caused by impact, crashes, falls, misuse, abuse, neglect, improper storage, improper installation, improper maintenance, or incorrect setup;
damage caused by modification, alteration, unauthorized repair, or incompatible third-party components;
damage caused by rocks, rails, trees, terrain features, resort equipment, vehicles, travel, airlines, shipping carriers, or other external forces;
damage from excessive heat, chemicals, solvents, UV exposure, improper cleaning, or environmental exposure beyond normal use;
Products used for rental fleets, commercial demos, institutional programs, or unauthorized resale unless approved in writing;
Products purchased from unauthorized sellers;
counterfeit, stolen, or secondhand Products;
incidental, indirect, special, consequential, or punitive damages.
If QSW determines that a Product is covered by warranty, QSW may, at its sole discretion, repair the Product, replace the Product, provide replacement parts, offer store credit, or issue a refund. This is your sole and exclusive warranty remedy to the fullest extent permitted by law.
To submit a warranty claim, you may be required to provide your name, email, phone number, order number or proof of purchase, description of the issue, photos or videos, and any other information reasonably requested by QSW.
Do not continue using a Product after submitting a warranty claim unless QSW confirms in writing that continued use is appropriate.
11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, EXCEPT FOR ANY EXPRESS LIMITED WARRANTY PROVIDED BY QSW IN WRITING, THE WEBSITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY LAW, QSW DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR PRODUCT INFORMATION.
QSW DOES NOT WARRANT THAT A PRODUCT WILL MEET YOUR EXPECTATIONS, BE SUITABLE FOR YOUR SPECIFIC USE, OR PREVENT INJURY, DEATH, EQUIPMENT DAMAGE, LOSS OF CONTROL, AVALANCHE HARM, OR OTHER LOSS.
Some jurisdictions do not allow limitations on implied warranties, so some limitations may not apply to you.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QSW, ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, INTERNS, AGENTS, AFFILIATES, ATHLETES, AMBASSADORS, SUPPLIERS, MANUFACTURERS, SERVICE PROVIDERS, RETAILERS, DISTRIBUTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES; LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF BUSINESS; LOSS OF GOODWILL; LOSS OF DATA; LOSS OF USE; EQUIPMENT DAMAGE; TRAVEL COSTS; LOST TIME; LOST OPPORTUNITY; RESCUE COSTS; MEDICAL COSTS; PERSONAL INJURY; DEATH; PROPERTY DAMAGE; OR OTHER LOSSES ARISING OUT OF OR RELATED TO THE WEBSITE, SERVICES, PRODUCTS, INSTALLATION, USE, MISUSE, DEMOS, FIELD TESTING, PRODUCT INFORMATION, DELAYS, SHIPPING, WARRANTY CLAIMS, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR ANY OTHER LEGAL THEORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, QSW’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE, SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO QSW FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE 6 MONTHS BEFORE THE CLAIM AROSE; OR (B) $100.
Some jurisdictions do not allow certain exclusions or limitations of liability, including for personal injury caused by certain conduct. In those jurisdictions, QSW’s liability will be limited to the maximum extent permitted by law.
13. Release of Claims
To the fullest extent permitted by law, you release QSW and its owners, members, managers, officers, directors, employees, contractors, interns, agents, affiliates, athletes, ambassadors, suppliers, manufacturers, service providers, retailers, distributors, and partners from any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses arising out of or related to:
your access to or use of the website;
your purchase, installation, inspection, maintenance, demo, testing, field use, misuse, or modification of any Product;
your participation in snowboarding, splitboarding, powsurfing, backcountry travel, avalanche terrain travel, demos, field tests, events, or related activities;
your failure to follow instructions, warnings, laws, resort rules, avalanche guidance, or safe practices;
third-party products, services, websites, carriers, payment processors, retailers, installers, technicians, or partners.
If you are a California resident, you waive California Civil Code Section 1542 to the fullest extent permitted by law. If you reside in another jurisdiction, you waive any comparable law, rule, or doctrine to the fullest extent permitted by law.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless QSW and its owners, members, managers, officers, directors, employees, contractors, interns, agents, affiliates, athletes, ambassadors, suppliers, manufacturers, service providers, retailers, distributors, and partners from and against any claims, demands, actions, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your use or misuse of the website or Products;
your installation, modification, maintenance, inspection, testing, demoing, resale, rental, or transfer of Products;
your violation of these Terms;
your violation of any law, regulation, rule, resort policy, or third-party right;
your reviews, photos, videos, posts, feedback, submissions, or communications;
your negligence, misconduct, or assumption of risk;
injury, death, or property damage involving you, your equipment, your use of Products, or your conduct.
QSW reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with QSW’s defense.
15. Intellectual Property and Submissions
All website content, product names, Product designs, photos, videos, copy, logos, graphics, drawings, CAD-related visuals, renderings, specifications, trademarks, trade dress, trade names, patents, patent-pending inventions, product configurations, and related materials are owned by QSW or its licensors and are protected by law.
Queen SNOWWORKS, QSW, QSW Surf Series, The Ace, The Jack, Monarch, Monarch Grip Technology, and related names, marks, designs, logos, and trade dress are owned by QSW or used by QSW. You may not use, copy, reproduce, modify, distribute, display, sell, reverse engineer, scrape, imitate, or create derivative works from QSW intellectual property without prior written permission.
If you submit reviews, comments, testimonials, photos, videos, feedback, suggestions, ideas, field-test notes, or other content to QSW, you represent that you have the right to provide it and that it does not violate any law or third-party right.
By providing content or submissions, you grant QSW a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, edit, adapt, distribute, and otherwise use that content for any lawful purpose, including marketing, product development, social media, website use, advertising, customer support, warranty review, and business operations.
Do not send confidential information, proprietary designs, inventions, product ideas, technical concepts, or business proposals unless QSW has specifically requested them under a separate written agreement.
16. Third-Party Services
Our website may link to or use third-party websites, platforms, payment processors, carriers, social media platforms, retailers, dealers, installers, athletes, event partners, or other third parties. QSW does not control and is not responsible for third-party content, policies, products, services, statements, or practices.
Your interactions with third parties are solely between you and the third party. QSW is not responsible for any loss, injury, damage, delay, defect, dispute, or claim arising from third-party products, services, websites, retailers, carriers, installers, technicians, events, or platforms.
17. Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the website, you acknowledge that our Privacy Policy is incorporated into these Terms by reference.
By using the website, purchasing Products, submitting forms, or contacting QSW electronically, you consent to receive communications from us electronically, including emails, notices, order confirmations, shipping updates, warranty communications, product updates, legal notices, and policy updates.
You agree that electronic communications satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by law.
18. Retail, Wholesale, Dealer, Athlete, and Ambassador Sales
Retail, wholesale, dealer, athlete, ambassador, employee, pro-form, collaboration, demo, or discounted purchases may be subject to additional written terms. Unless authorized in writing, discounted or special-program Products may not be resold, rented, commercially demoed, transferred for profit, or used outside the stated program.
QSW may revoke access to special pricing, programs, or dealer privileges at any time for abuse, misrepresentation, policy violations, safety concerns, unauthorized resale, or brand misuse.
19. Changes and Termination
We may update, change, suspend, or discontinue the website, Products, content, pricing, policies, or these Terms at any time. The “Last Updated” date will indicate the latest version.
Your continued use of the website or Products after changes are posted constitutes acceptance of the updated Terms, except where prohibited by law.
We may terminate, suspend, or restrict your access to the website, cancel accounts, remove content, or cancel orders at any time, with or without notice, where permitted by law.
Sections that by their nature should survive termination will survive, including product risk, assumption of risk, warranties, disclaimers, limitation of liability, release, indemnification, intellectual property, dispute resolution, governing law, and general terms.
20. Dispute Resolution, Governing Law, and Venue
Before initiating arbitration or any legal proceeding, you and QSW agree to first attempt to resolve any dispute informally. To start the informal process, email QueenSnowWorks@gmail.com with the subject line “Legal Dispute Notice” and include your name, contact information, order number if applicable, a description of the dispute, and the relief requested.
To the fullest extent permitted by law, any dispute arising out of or relating to the website, Products, purchases, demos, field testing, these Terms, Product use, Product information, warranties, returns, communications, or your relationship with QSW will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies or seek temporary injunctive relief to protect intellectual property, confidential information, trade secrets, or safety-related interests.
YOU AND QSW AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
These Terms and any dispute between you and QSW are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement.
For any dispute not subject to arbitration or small claims court, you and QSW agree to the exclusive jurisdiction and venue of the state or federal courts located in Salt Lake County, Utah, unless applicable law requires otherwise.
To the fullest extent permitted by law, any claim or cause of action arising out of or related to the website, Products, purchases, demos, field testing, warranties, returns, communications, or these Terms must be filed within 1 year after the claim arose, or it is permanently barred.
21. Miscellaneous
These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and QSW regarding the website and Products, unless you have a separate written agreement signed by QSW.
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law.
QSW’s failure to enforce any provision is not a waiver of its right to do so later.
You may not assign or transfer these Terms without QSW’s prior written consent. QSW may assign or transfer these Terms, in whole or in part, without restriction.
QSW will not be liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, weather, labor disruptions, supply chain disruptions, carrier delays, cyber incidents, equipment failure, government action, or other force majeure events.
